1. scope of application
The general terms and conditions apply to all orders placed via our online store "New Mom Generation" (hereinafter referred to as "Online Shop").

4. conclusion of contract
The product descriptions contained in the online store of the seller do not represent binding offers on the part of the seller, but serve to submit a binding offer by the customer. The contract is concluded by the customer / the customer places his order and pays. If we do not respond to your order within 2 weeks, you are no longer bound by it. Before the conclusion of the contract (i.e. the acceptance of your offer by us) there is no claim for fulfillment, e.g. for the delivery of ordered goods.

Order processing and contacting usually take place via e-mail and automated order processing. The customer must ensure that the e-mail address he/she provides for order processing is correct, so that e-mails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.

Our online store is aimed exclusively at consumers. We therefore accept orders only in household quantities.

5. shipping costs
In addition to the stated product prices, shipping costs will be added. You can find out more about the shipping costs under the menu item Shipping and Returns. In the case of shipping abroad, you will also be responsible for any customs duties as well as export and import fees.

For the return costs, in the case of effective exercise of the right of withdrawal by the customer, the provision made in this regard in the cancellation policy of the seller.

The delivery of goods is made by shipping to the delivery address specified by the customer, unless otherwise agreed. In the processing of the transaction, the delivery address specified in the order processing of the seller is decisive.

If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer shall bear the costs for the unsuccessful shipment. This does not apply if the customer is not responsible for the circumstance that led to the impossibility of delivery or if the customer was temporarily prevented from accepting the offered service, unless the seller had given the customer a reasonable amount of notice. Furthermore, this does not apply with regard to the costs for the Hinsendung if the customer effectively exercises his right of withdrawal.

Self-collection is not possible for logistical reasons.

6. revocation instruction
You must return the goods received from us immediately and in any case no later than fourteen days from the day on which you notify us of the revocation of this contract. The customer is responsible for the return shipping costs.

If you revoke the contract, we will refund all payments for the purchased goods that we have received from you. This repayment will be made immediately and at the latest within fourteen days from the day on which we received the notification of your revocation of the contract. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you. We will not charge you any fees for the repayment in any case. We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods.

We would like to point out that we are not obliged to take back obviously used goods. We would also like to point out that you can claim compensation for any damage to the goods caused by you.

The right of withdrawal does not apply to consumers who do not belong to a Member State of the European Union at the time of conclusion of the contract and whose sole residence and delivery address are outside the European Union at the time of conclusion of the contract.

7. payment
Payment can be made by PayPal, credit card or direct debit. We use the offer PayPal Express Checkout and Shopify Payments (Stripe) for this purpose.

If you have chosen the payment method PayPal, you must be registered there to be able to pay the invoice amount or you must first register and legitimize yourself with your access data. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment instruction. You will be redirected to the website of the online provider PayPal for the payment. There you can enter your payment data, confirm the use of your data by PayPal and the payment instruction to PayPal.

If you choose the payment method "Credit Card", "Sofortüberweisung", "Invoice" or "Giropay" of the payment service provider Stripe, the payment transaction will be processed by the payment service provider Stripe Payments Europe Ltd, Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland. The payment transaction will be executed by Stripe after confirmation of the payment instruction.

8. retention of title
The goods remain our property until full payment has been received.

9. transport damages
If goods are delivered with obvious transport damage, please claim such defects as soon as possible to the delivery company and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the carrier or transport insurance.

11. contract language
The language available for the conclusion of the contract is German.

12. gift vouchers
Gift vouchers are vouchers that you - as far as offered by us - can purchase. Gift vouchers can only be redeemed in the online store. If the balance of a gift certificate is not sufficient for the order, the difference can be made up with the payment options offered. Gift certificates and credits can only be redeemed before completing the order process.

The balance of a gift certificate will not be paid out in cash, nor will it earn interest. Gift certificates are valid for four years from the date of purchase.

Promotional gift certificates can only be redeemed before the order process is completed. Subsequent offsetting is not possible.

Only one promotional voucher can be redeemed per order.

13. applicable law
The law of the Federal Republic of Germany shall apply to all legal relationships between the parties to the exclusion of the laws on the international purchase of movable goods. In the case of consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence.

14. severability clause
Should any provision of these GTC not be valid, the statutory provisions shall apply instead of the invalid provision. The legal validity of all other provisions shall in any case not be affected.
