2 Collection, storage and use of personal data

2.1 When visiting our website

When you visit our website www.newmomgeneration.com, information is automatically sent to the server of our website by the browser used on your end device. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automated deletion:

IP address of the requesting computer,
Date and time of access,
Name and URL of the accessed file,
website from which the access was made (referrer URL),

The aforementioned data is processed by us for the following purposes:

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest follows from the purposes for data collection listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

2.2 When using further functions and offers of our website

In addition to the purely informational use, we offer various services that you can use if you are interested. For this purpose, you usually have to provide further personal data, which we use to provide the respective service.

a) Registration for our newsletter

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted after you unsubscribe from the newsletter. Data that has been stored by us for other purposes (e.g. e-mail addresses for the member area) remains unaffected by this.

This website uses the services of MailChimp for sending newsletters. The provider is Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

MailChimp is a service with which, among other things, the sending of newsletters can be organized and analyzed. When you enter data for the purpose of receiving newsletters (e.g. e-mail address), this data is stored on MailChimp's servers in the USA.

MailChimp has a certification according to the "EU-US Privacy Shield". The "Privacy Shield" is an agreement between the European Union (EU) and the USA, which is intended to ensure compliance with European data protection standards in the USA.

With the help of MailChimp, we can analyze our newsletter campaigns. When you open an email sent with MailChimp, a file contained in the email (so-called web-beacon) connects to MailChimp's servers in the USA. This makes it possible to determine whether a newsletter message has been opened and which links, if any, have been clicked. In addition, technical information is recorded (e.g. time of retrieval, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. It is used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you do not want any analysis by MailChimp, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message. Furthermore, you can also unsubscribe from the newsletter directly on the website.

The data processing is based on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you have provided to us for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from the servers of MailChimp after you unsubscribe from the newsletter. Data that has been stored by us for other purposes (e.g. e-mail addresses for the member area) remains unaffected by this.

b) Use of our store

If you want to order in our webshop "Bad Moms Club", it is necessary for the conclusion of the contract that you provide your personal data, which we need for the processing of your order. Mandatory information necessary for the processing of the contract is marked separately, other information is voluntary. We process the data you provide to process your order. For this purpose, we may also pass on your payment data to third parties (such as carriers, logisticians, banks, payment providers), insofar as this is necessary for the order and order processing. This includes in particular the transfer to the provider "Shopify", through which our store is hosted. The legal basis for this is Art. 6 para. 1 p.1 lit.b DSGVO.

We are obliged by commercial and tax law to store your address, payment and order data for a period of 10 years.

2.3 Passing on to third parties

Insofar as we use external service providers to process your data, these have been carefully selected and commissioned by us. Furthermore, they are bound by our instructions through the conclusion of order data processing contracts in accordance with § 28 DSGVO and are regularly monitored by us.

As a general rule, we will only disclose your personal data to third parties if:

you have given your express consent to do so in accordance with Art. 6 (1) p. 1 lit. a DSGVO,
the disclosure is necessary for the assertion, exercise or defense of legal claims pursuant to Art. 6 (1) p. 1 lit. f DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
in the event that there is a legal obligation for disclosure pursuant to Art. 6 (1) p. 1 lit. c DSGVO, as well as
this is legally permissible and necessary according to Art. 6 para. 1 p. 1 lit. b DSGVO for the processing of contractual relationships with you.

3. use of cookies/html storage objects

We use cookies on our website. These are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone or similar) when you visit our website. Cookies do not cause any damage to your end device, do not contain viruses, Trojans or other malware. Accepting cookies is not a prerequisite for visiting our websites. Your name, IP address or similar data that would allow the cookie to be assigned to you are not placed in the cookie. Based on the cookie technology, we only receive pseudonymized information, for example, about which pages of our store were visited, which products were viewed, etc..

Furthermore, we use HTML5 storage objects that are stored on your terminal device. These objects store the required data independently of the browser you are using and have no automatic expiration date. You can prevent the use of HTML5 storage objects by setting your browser to private mode. We also recommend that you manually delete your browser history on a regular basis.

The use of HTML5 storage objects serves to make the use of our offer more pleasant for you. The legal basis for the use is Art. 6 para. 1 p. 1 lit. f DSGVO.

4. use of analysis tools

The tracking measures listed below and used by us are carried out on the basis of Art. 6 (1) p. 1 lit. f DSGVO. With the tracking measures used, we want to ensure a needs-based design and the ongoing optimization of our website. On the other hand, we use the tracking measures to statistically record the use of our website and evaluate it for the purpose of optimizing our offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

4.1 Google Analytics

4.2 Google Adwords Conversion Tracking

In order to statistically record the use of our website and to evaluate it for the purpose of optimizing our website for you, we also use Google Conversion Tracking. In this process, Google Adwords sets a cookie (see section 3) on your computer if you have accessed our website via a Google ad.

These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer's website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page.

Each Adwords customer receives a different cookie. Cookies can therefore not be tracked across Adwords customers' websites. The information obtained using the conversion cookie is used to create conversion statistics for Adwords customers who have opted for conversion tracking. The Adwords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

5. use of Facebook remarketing

On our website, we use the remarketing function "Custom Audiences" of Facebook Inc. on the basis of Art. 6 para. 1 p. 1 lit. f DSGVO. This function is used to present interest-based advertisements ("Facebook Ads") to visitors to our website when they visit the social network Facebook. For this purpose, the remarketing tag of Facebook has been implemented on our website. Via this tag, a direct connection to the Facebook servers is established when visiting the website. In the process, it is transmitted to the Facebook server that you have visited our website and Facebook assigns this information to your personal Facebook user account.

5.1 Our website uses the visitor action pixel from Facebook, Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") for conversion measurement.

This makes it possible to track the behavior of site visitors after they have been redirected to the provider's website by clicking on a Facebook ad. This allows the effectiveness of the Facebook ads to be evaluated for statistical and market research purposes and future advertising measures to be optimized.

The collected data is anonymous for us as the operator of this website, we cannot draw any conclusions about the identity of the users. 6. use of Youtube videos

This website uses the Youtube embedding function to display and play videos of the provider "Youtube", which belongs to Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

Here, the extended data protection mode is used, which, according to the provider, only triggers the storage of user information when the video(s) is/are played. If the playback of embedded Youtube videos is started, the provider "Youtube" uses cookies to collect information about user behavior. According to information from "Youtube", these are used, among other things, to collect video statistics, to improve user-friendliness and to prevent abusive behavior. If you are logged in to Google, your data is directly assigned to your account when you click on a video. Independently of a playback of the embedded videos, a connection to the Google network "DoubleClick" is established each time this website is called up, which may trigger further data processing operations without our influence.

Google LLC, based in the USA, is certified for the us-European data protection agreement "Privacy Shield", which ensures compliance with the level of data protection applicable in the EU.

7. use of Shopify Payments (Stripe) and PayPal

7.1 Stripe

If you choose the payment method "credit card", "Sofortüberweisung" or "Giropay" of the payment service provider Stripe, the payment is processed via the payment service provider Stripe Payments Europe Ltd, Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland, to whom we pass on your information provided during the ordering process together with information about your order (name, address, account number, bank code, possibly credit card number, invoice amount, currency and transaction number). 7.2 On our website we offer, among other things, payment via PayPal. The provider of this payment service is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal").

If you select payment via PayPal, the payment data you enter will be transmitted to PayPal.

The transmission of your data to PayPal is based on Art. 6 para. 1 lit. a DSGVO (consent) and Art. 6 para. 1 lit. b DSGVO (processing for the performance of a contract). You have the option to revoke your consent to data processing at any time. A revocation does not affect the validity of past data processing operations.

Within the website visit, we use the widespread SSL procedure (Secure Socket Layer) in conjunction with the highest encryption level supported by your browser. As a rule, this is a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is encrypted by the closed key or lock symbol in the lower status bar of your browser.
